Terms of Use - Artwork
Use of this artwork constitutes full and binding agreement to the following definitions, including but not limited to all liabilities, indemnification, copyrights and credits. This agreement is applicable whether you have read these terms or not. You understand you are not granted exclusive rights and domain to this artwork.
This is a single user license. It cannot be shared with anyone else.
You are not required to link back to my site, though it is appreciated.
You may use this artwork for any purpose such as web page design, email cards, signature tags, etc. However, the finished item must be an entirely new creation in order to be offered for sale to customers. Cropping part of the image or downsizing it and slapping a signature on it is NOT acceptable for resale to customers. It is acceptable for PERSONAL use only.
You may use this artwork in new designs as often as you wish, as long as you follow the Terms of Use.
You may make variations in opacity or colorization of an image, crop, resize, use part of the image or the entire image.
You may make prints for your own use, such as a framed print for decoration, invitations, or newsletters, or any item you are not reselling for a profit. You may use it as a pattern for a personal tattoo for yourself.
You may use this artwork to make a tube, stamp or a brush for your own personal use in your own design, client design, a web set, linkware, or a template you intend to license as shareware for your own resale.
Using my artwork in an item that is to be mass produced for resale is NOT allowed. A special license is required. Mass reproduction refers to instances of 20 items or more at a time.
This license is not valid for using my artwork to create templates to upload to a site like monster template.com., template.com., or any other similar site. A separate commercial use license is required.
You may not make multiple prints or any prints for the purpose of resale with this artwork.
You may not post this artwork in full size, high resolution format on the web.
You may not post this artwork on the web as is for any kind of sale for commercial profit. You MUST create a new template or web set design in order to post any part of this image for sale for commercial profit.
You may not claim this artwork as your work after making minor alterations such as changes in opacity, cropping or resizing, and colorization.
You may not, under any circumstances hand this artwork over to another designer or artist to be reworked or redesigned beyond the minor changes as posted above.
You may not use this artwork in any manner that places the resulting creation you make in competition with my clip art or artwork.
You may not upload this artwork to any site such as Zazzle or Cafe Press for the purpose of offering it for sale in a printed format for a profit.
You may NOT slap a cross-stitch pattern on this artwork, call it your own, and upload it to ebay, etsy, or any online shop and offer it for sale.
You may not make stamps, tubes or brushes with this artwork for the purpose of resale.
You do not have the right to redistribute the original file nor any copies, in whole or in part, in any collections. No file sharing of any kind or digital collection on the internet or in any media collection that is shared or resold.
You may not make any false representation or claims as to the creator of these background images. M. C. Krauss (and any of her applicable licensors) retains all and implied copyrights.
You agree that the purpose for which you intend to use this artwork is strictly legal business, ecommerce or otherwise, or personal enjoyment, and have no intent now or in the future for pursuing any illegal or hostile activities online or offline using this artwork as a basis for said activities. You agree that no person or persons, with your permission and partial or full knowledge, will attempt to link to the site where the artwork is posted, use the site where the artwork is posted or use this artwork in any hostile or illegal activities. If you withhold any information as to the purpose of the site where this artwork is posted or any information regarding printed use of the artwork from M. C. Krauss, the artist, will not be held legally responsible for any fines, damages, attorney fees, court fees, etc., levied against you by any or all injured parties seeking damages or monetary retribution by civil or criminal lawsuit, including local, state, federal, international, or civil parties.
M. C. Krauss is not responsible to you, any person or organization for any damages arising in any manner out of the use of the content and/or information made available on this site.
